Capacity to adiate

Regarding the comment on who has the capacity to adiate, I respectfully refer Mr Crowhust to the unreported case of Eyssel and Another v Barnes NO and Others 3617/92, handed down by the High Court NPD where it was held that the power to adiate vests in the heirs and not the executor.
