Cape Town Registrar's Circular 5/2008

Cape Town Registrar's Circular No.5 of 2008 - deals with the following:

1. Massing and adiation - executor cannot adiate where massing has taken place.
2. Trusts and Section 40 endorsements - when a deed must be endorsed in terms of Section 40 of Act 66/1965 and when a proper transfer must take place.
3. Sales and Section 18(3) of Act 66/1965 - clarification of its application.
4. Multiple mortis causa trusts - Separate mortis causa trusts will be regarded as separate legal personae with distinctive names to differentiate them but will have the same "MT" number.
