The Chief Registrar's Circular No.2 of 2006 concerns the effect of certain provisions on registration procedures of the Municipal Property Rates Act, No.6 of 2004, which came into effect on 2 July 2005. The purpose of the Act is, amongst other things, to regulate the power of a municipality to impose rates on property.
Three aspects of registration procedures which are affected by the Act are the subject of this circular. They are:
- the definition of property;
- the lodgement of rates clearance certificates with the registration of a transfer of property; and
- the lodgement of rates clearance certificates with the registration of a cession of a right registered against immovable property.
