As we reported in Tax and "unnamed nominees", the original purchaser must disclose the name of the nominee. Aiden Kenny, commercial property specialist at law firm Jan S de Villiers says there are a number of ways to avoid the double duty predicament. These are:
* pre-incorporation contracts for companies or close corporations,
* a contract for the benefit of a third party, and
* a tripartite agreement.
