Smarter property law

The first draft of a new provincial land law that will radically simplify the process of approving property developments in the Western Cape is expected to be revealed this week. Once in force it is likely that there will be:

  • One application form,
  • One public participation process,
  • One official decision, and
  • One appeal process which will involve an independent tribunal "to provide checks and balances".
The draft provides for integrated planning, driven by sustainable development principles and objectives, and it comes soon after the implementation of a provincial spatial development framework (SDF) for the Western Cape. The SDF sets strict new rules for property development in an attempt to control rampant environmental degradation. Comments will be allowed until 31 August, and the final draft should be presented to the provincial cabinet by March next year.
