In terms of section 20 of the Deeds Registries Act. no. 47 of 1937 deeds shall be executed in the presence of the Registrar. It has come to the attention of the Registrar that some deeds are executed outside the execution room.
To minimise the risk of deeds being executed by someone other than the conveyancers mandated in the powers of attorney, a daily attendance register for conveyancers will be kept at execution.
Conveyancers will have to complete their full names, as well as the numbers of all the firms for whom they execute on the particular day, under their signature.
Only conveyancers will be allowed to present deeds to the DOTS personnel to he scanned “at execution”. The Registrar will make spot checks from time to time, to control whether conveyancers adhere to this practice. This practice will commence on Wednesday 19 February 2014.
