Building owners to celebrate?

According to Dave Bennet, member of the property committee of the law society of the northern provinces, this ruling will have far reaching consequences because owners of buildings could no longer be responsible for the debts of their tenants. And these debts run into millions of rand.

The decision of Mkontwana v Nelson Mandela Metropolitan Municipality and others (1238/02), now has to be upheld or rejected by the Constitutional Court.

The Law Society of South Africa came out in strong support of the ruling and has already asked its members to contribute financially to this pending decision. If it is upheld, municipalities will be forced to implement correct and efficient rates collection mechanisms.
