Chief Registrar's Circular 2/2006

The Chief Registrar's Circular No.2 of 2006 concerns the effect of certain provisions on registration procedures of the Municipal Property Rates Act, No.6 of 2004, which came into effect on 2 July 2005. The purpose of the Act is, amongst other things, to regulate the power of a municipality to impose rates on property.

Three aspects of registration procedures which are affected by the Act are the subject of this circular. They are:

  • the definition of property;
  • the lodgement of rates clearance certificates with the registration of a transfer of property; and
  • the lodgement of rates clearance certificates with the registration of a cession of a right registered against immovable property.
