Chief Registrar's Circular No. 7/2013 - Subdivision of section 25 right and suspension of RCR 70(c) of 2011 and RCR 56 of 2012

1. A sectional plan does not indicate the extent of a right of extension of a scheme as contemplated in section 25 of the Sectional Titles Act, 1986 (Act No. 95 of 1986). A sectional plan relating to a subdivision of such right of extension does also not make reference to the extent of the right so subdivided.


2. Form F (Certificate of Real Right) has been amended by Government Notice No. R.196, Government Gazette No. 36241 dated 14 March 2013, to provide for the disclosure of the extent of a subdivided right of extension. This amendment was an oversight and will be referred to the Sectional Titles Regulations Board for correction. The status quo followed prior to the amendment of Form F must remain, pending the referral of the amendment.


3. RCR 70 (c) of 2011 and RCR 56 of 2012 are hereby suspended with immediate effect and will be referred to the next Registrars’ Conference for withdrawal.
