Chief Registrar's Circulars 8 and 10/2005

Chief Registrar's Circular's Nos. 8 to 10 of 2005 were recently issued. It is the last two which are of most interest to the conveyancer. Before turning to them, I would like to note that CRC 8 only concerns the name change of Standard General Insurance Company Limited to Nova Life Limited and Nova Life Partners Limited.

Chief Registrar's Circular No. 9 of 2005
This circular provides for the commencement of the amended regulations to the Sectional Titles Act 95 1986 as published in Government Gazette No. 27561. The nature and/or impact of the amendments are briefly as follows:

  • The heading of Regulation 17 has been changed to "Alienation and letting of common property".
  • Regulation 27 now prescribes the documents necessary for an application for the registration of a plan of extension of the common property.
  • Regulation 28 has two added subregulations: Subregulation (4) prescribes the procedures which must be followed in ceding exclusive use areas to a beneficiary yet which remain registered in the name of a person who has ceased to be a member of the body corporate. Subregulation (5) of Regulation 28 prescribes what procedures must be followed in obtaining a separate title deed for an individual exclusive use area in cases where exclusive use areas are held by means of one title deed.
  • A number of forms - Forms AG to AI - have also been inserted, as a consequence of the amendment to Regulation 28, while Forms G, H and O have been amended for other reasons.

Chief Registrar's Circular No. 10 of 2005
This circular provides for the coming into effect on 20 June of the amended regulations to the Deeds Registries Act 47 of 1937. In brief, Regulation 68(1) has been amended with the deletion of a number of subregulations - Subregulations 1A to 1D, and the substitution of subregulation (11). Forms GGG and HHH have been deleted while a Chief Registrar's Circular and certain paragraphs in Chief Registrar's Circulars which deal with Regulation 68 have been repealed.
