Please be advised of the following changes in respect of filing of Rules:
1. In terms of Item 5(i) of the Schedule of Fees which came into operation on 1 May 2015 as published in Government Gazette Notice No. R269 of 31 March 2015, fees are now charged for the Substitution, Adding, Amendment or Repeal of Management Rules and / or Conduct Rules as contemplated in Section 35(5) of the Sectional Titles Act 95 of 1986.
2. Item 5(i) provides a fee is payable of R150.00.
3. This fee must be paid directly into the Deeds Registries Trading Account and proof of payment must be lodged together with the notification and Section 35(5) Rules.
4. The name of the scheme must be used as reference when such payment are made.
This will be implemented with immediate effect.
If the filing of the rules are attended to by a Attorney Firm on behalf of the managing agent/body corp. Can the fee of R150.00 be debited to the account of the Attorney Firm? This is the usual practice or must the amount be paid in cash?
