Deeds Registries Amendment Act

It amends section 17 of the Deeds Registries Act 47 of 1937 by creating further provisions for the registration of immovable property for persons in customary marriages. Section 102 is also amended to include a trust in the definition of a person. This changes the way in which a trust is described in powers of attorney, mortgage bonds and deeds of transfer.

Kindly note that the office of the Chief Registrar of Deeds is in the process of drafting a circular on the application of the amendment to section 17 (4). In its present form the deeds registries cannot apply the proviso .
