Pretoria Registrar's Circular 04 of 2013 - lodgement of rates clearance certificates by the City of Johannesburg with regard to Sectional title registrations.

1. Purpose
The lodgement of rates clearance certificate by the City of Johannesburg with regard to Sectional title registrations. Herewith find a letter from the City of Johannesburg which is self-explanatory.

2. Simultaneous transfers
Examiners please note that Johannesburg Municipality insists on the lodgement of a rates clearance certificate for the LAND on the OPENING of a sectional title scheme as well as a PHASE development where simultaneous transfers are registered irrespective of whether a Body Corporate has been established or not.

For all other areas no rates clearance certificate for the land is required for a phase development if a body Corporate has been established —see RC 11 of 2013.

3. Validity
Further note that this letter is only applicable to rates clearance certificates issued by the City of Johannesburg and the letter is only valued until 31 December 2014.
